Childcare contract

1. Childcare
The Notfallmamas provide emergency childcare through qualified caregivers for sick children or in cases where regular childcare is unavailable — for example, due to unavoidable business appointments or travel by employees — in the children’s own home. Notfallmamas ensure that all caregivers are carefully selected. A prerequisite for employment in childcare is the submission of a valid police clearance certificate and proof of completion of a first aid course for children. The respective caregiver undertakes to provide responsible care and supervision of the child/children during the agreed hours. Household chores, except for preparing meals for the children, are not part of the Notfallmamas’ services. Legal guardians and caregivers coordinate on all matters relating to the childcare arrangement. Care includes providing for the child’s needs, ensuring safety, and offering opportunities for age-appropriate play and behavior. Walks or playground visits are also possible by prior arrangement.

Special Childcare Arrangements:
For the placement of our staff in a private household, we charge a flat fee of €750.00 plus VAT. This fee becomes due if our staff members work for a family outside of a childcare assignment contracted between Die Notfallmamas GmbH and the parents. The placement fee must be paid by the person who initiated the placement (poaching).

2. Childcare Hours

The times during which the child/children are cared for depend on the absence periods of the legal guardian(s) and are agreed upon individually. The minimum duration of care is four hours per day.

3. Daily Care Fee
Notfallmamas GmbH receives a daily care fee for emergency childcare, which becomes due in accordance with the company’s offer or contractual agreement. Any employee co-payments, as defined in the company agreement, will be deducted from the salary or, once the company’s allocated quota is exhausted, invoiced directly to the employee. Internal company regulations remain unaffected. Billing is always based on full hours.

4. Illness of the Child/Children
The legal guardians authorize the caregiver in writing (see attachment) to arrange for medical treatment of the child/children in emergencies and provide a copy of the vaccination record. The legal guardians must be informed immediately of any incidents.

The legal guardians undertake to continuously inform the caregiver about the child’s/children’s state of health (e.g., any susceptibilities, allergies, necessary medication, etc.).

If the administration of medication is or becomes necessary, the legal guardians grant the caregiver express permission to do so (see attachment).

5. Liability Insurance
Notfallmamas GmbH maintains liability insurance for all employees, covering personal injury and property damage involving the children under their care during the childcare period.

6. Duty of Confidentiality and Disclosure
The contracting parties agree to provide all information essential to the care of the child/children. They also undertake to maintain confidentiality regarding all matters affecting the personal sphere of the other contracting party that, by their nature, require discretion. This obligation remains in force even after the termination of the contractual relationship. The employee hereby reconfirms written consent for Notfallmamas to share personal data (parents’ names, child’s name, child’s age, and address) with the company. The contracting parties also agree not to make or have made any image and/or sound recordings during the childcare period. If video cameras and/or voice assistant systems are present in rooms used during the childcare period, the client undertakes to deactivate them or—if this is not possible—to inform the caregiver about the systems in advance.

I hereby confirm that I authorize the care of my child/children during the times stated above by a caregiver from Die Notfallmamas GmbH.
